DMCA Copyright Policy

1. Overview

All Night Tarot, operated by The Arcane Fiend ("we," "us," or "our"), respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to notices of alleged copyright infringement on our Service.

2. Copyright Infringement Notification

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Service, please notify our designated Copyright Agent as specified below.

2.1 Requirements for DMCA Takedown Notice

For your notice to be effective under the DMCA, it must include the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
  2. Identification of the infringing material: A description of where the material that you claim is infringing is located on the Service, with sufficient detail that we can find it. Providing URLs in the body of an email is the best way to help us locate content quickly.
  3. Your contact information: Your name, address, telephone number, and email address.
  4. A statement of good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

2.3 False Claims

WARNING: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. You may wish to consult with a lawyer before filing a DMCA notice.

3. Our Response to DMCA Notices

Upon receiving a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who posted the material that it has been removed or disabled
  3. Provide the user with a copy of the DMCA notice
  4. For repeat infringers, terminate their accounts in appropriate circumstances

4. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent.

4.1 Requirements for Counter-Notification

To be effective, a counter-notification must include the following:

  1. Your physical or electronic signature
  2. Identification of the material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
  3. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your contact information: Your name, address, and telephone number
  5. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Oregon if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

4.2 Where to Send Counter-Notifications

Counter-notifications should be sent to our Copyright Agent at the address listed in Section 2.2 above.

4.3 What Happens After a Counter-Notification

If we receive a valid counter-notification, we will forward it to the person who filed the original DMCA notice. If the original complainant does not file a court action seeking an order to restrain the allegedly infringing activity within 10-14 business days, we may restore the removed material or cease disabling access to it.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. User Responsibilities

As outlined in our Terms of Service, users are responsible for ensuring that any content they upload, including images of tarot cards, complies with copyright law. This means:

  • You own the copyright to the images you upload, OR
  • Your use falls within fair use under copyright law, OR
  • You have obtained permission from the copyright holder to use the images

Users who upload infringing content may have their content removed and their accounts terminated, and may be held liable for any damages resulting from copyright infringement.

7. Fair Use Considerations

We recognize that some uses of copyrighted material may constitute fair use under U.S. copyright law. Fair use is a case-by-case determination that depends on factors including:

  • The purpose and character of the use (e.g., transformative, educational, commercial)
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used
  • The effect of the use on the potential market for the original work

However, we cannot provide legal advice about whether a particular use constitutes fair use. If you are uncertain whether your use of copyrighted material is lawful, we recommend consulting with an attorney.

8. Limitations on Our Liability

We act as a service provider under the DMCA and qualify for the safe harbor protections provided under Section 512(c). This means:

  • We do not monitor or pre-screen user-uploaded content
  • We respond to valid DMCA notices by removing allegedly infringing content
  • We are not liable for copyright infringement by our users, provided we comply with the DMCA

However, users remain fully liable for any content they upload that infringes on third-party copyrights, as outlined in our Terms of Service.

9. Special Note for Tarot Deck Artists

We understand that tarot deck artists invest significant time and creativity into their work. If you are a tarot deck artist and believe your work is being used inappropriately on our platform, please file a DMCA notice as outlined above. We take copyright protection seriously and will respond promptly to valid notices.

For users: please respect the work of tarot deck creators. Consider the following best practices:

  • Use only a small number of cards from any single deck in your readings
  • Credit the deck creator and deck name when sharing readings publicly
  • Consider purchasing decks you use regularly to support the artists
  • If in doubt about whether your use is appropriate, contact the deck creator for permission

10. Modifications to This Policy

We reserve the right to modify this DMCA Copyright Policy at any time. We will notify users of material changes by updating the "Last Updated" date at the top of this policy and, for registered users, by email.
