2. Description of Service
All Night Tarot is a software platform that enables users to create, share, and manage tarot readings. Our Service is available to both individual enthusiasts and professional tarot readers.
3. User Accounts
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
4. Copyright and Intellectual Property
4.1 Your Content
You retain ownership of all content you upload to the Service, including images, readings, and any other materials (collectively, "Your Content").
4.2 Copyright Compliance and Indemnification
By uploading or using any images, including but not limited to tarot card imagery, on the Service, you represent and warrant that:
- You own the copyright to such images, OR
- Your use of such images falls within the bounds of fair use under applicable copyright law, OR
- You have obtained all necessary permissions, licenses, or rights from the copyright holder(s) to use such images in the manner you are using them on the Service
You agree to indemnify, defend, and hold harmless The Arcane Fiend, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising from or related to:
- Any claim that Your Content infringes or violates any third-party intellectual property rights, including copyright
- Your use of images on the Service
- Any legal action brought against us as a result of Your Content
If we incur legal fees or costs as a result of being named in any lawsuit or legal proceeding related to Your Content or your use of images, you agree to reimburse us for all such fees and costs.
4.3 License to Your Content
By uploading Your Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of operating and providing the Service to you and other users.
5. Paid Readings and Service Tiers
5.1 Professional Use Restriction
Only users with an active paid Professional subscription plan ("Pro Plan") are authorized to use the Service to provide paid tarot readings or to receive any form of compensation (monetary or otherwise) in exchange for readings created through the Service.
5.2 Permitted Uses for All Users
All users, regardless of subscription tier, are welcome and authorized to:
- Share readings on social media platforms
- Share readings with friends, family, or other individuals
- Create readings for personal use
- Use the Service for non-commercial purposes
5.3 Violation of Professional Use Restriction
Using the Service to provide paid readings or receive compensation for readings without an active Pro Plan subscription constitutes a material breach of these Terms and may result in immediate termination of your account.
6. User Conduct and Responsibilities
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Upload content that infringes on intellectual property rights
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service to transmit viruses, malware, or other harmful code
- Harass, abuse, or harm other users
7. Disclaimers and Liability for Reader Claims
7.1 Nature of Tarot Readings
Tarot readings provided through the Service are for entertainment and personal insight purposes only. The Arcane Fiend does not endorse, verify, or take responsibility for any readings, interpretations, predictions, or advice provided by individual readers using the Service.
7.2 Reader Responsibility
You acknowledge and agree that you, as the reader or content creator, are solely responsible for all statements, claims, predictions, advice, and interpretations you make through the Service. This includes but is not limited to:
- The accuracy or inaccuracy of any readings or predictions
- Any advice or guidance provided to individuals receiving readings
- Any reliance placed by others on your readings or statements
- Any consequences resulting from readings you provide
7.3 Indemnification for Reader Claims
You agree to indemnify, defend, and hold harmless The Arcane Fiend, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising from or related to:
- Any readings, predictions, advice, or statements you provide through the Service
- Any claims made by individuals who received readings from you
- Any alleged harm, damage, or reliance by third parties on your readings or content
- Any legal action brought against us as a result of your readings or statements
If we incur legal fees or costs as a result of being named in any lawsuit or legal proceeding related to your readings, statements, or claims, you agree to reimburse us for all such fees and costs.
7.4 Disclaimer for Viewers of Content
If you are viewing tarot readings or other content created by other users of the Service (whether or not you have your own account), you acknowledge and agree that:
- All readings and content are created by independent users, not by The Arcane Fiend
- The Arcane Fiend makes no representations or warranties about the accuracy, reliability, or quality of any readings or content
- You access and rely on such content at your own risk
- The individual reader or content creator is solely responsible for their statements and claims
- Any claims, disputes, or issues arising from readings or content should be directed to the individual reader, not to The Arcane Fiend
8. Payment and Subscriptions
Certain features of the Service require payment of fees. You agree to pay all applicable fees as described on the Service. All fees are non-refundable unless otherwise stated. We reserve the right to change our fees at any time, with notice to existing subscribers.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ARCANE FIEND, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or other harmful code transmitted to or through the Service by any third party
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service
- Any readings, predictions, or advice provided by users of the Service
IN NO EVENT SHALL THE ARCANE FIEND'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO THE ARCANE FIEND IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Oregon, and you consent to the personal jurisdiction of such courts.
13. International Use
The Service is controlled and operated from the United States. We make no representation that the Service is appropriate or available for use in all locations. If you use the Service from outside the United States, you are responsible for compliance with local laws.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and The Arcane Fiend regarding the Service and supersede all prior agreements and understandings, whether written or oral.
